Cedar Court Detention Pond Access
There is a private HOA easement that is recorded in the plat as a twenty feet wide easement belonging to the HOA members. This information can be found listed in the Articles of Incorporation and the County Assessors Office or website on the scopi map with the same parcel number as the rest of the common areas.
The maintained width of this cannot be enforced by the City because it is private property of the HOA and an HOA matter. Fire and Building codes require twenty feet of unobstructed access.
There was a complaint filed that the people living at 13987 Cedar Court had encroached on the HOA property with a fence and rock retaining wall reducing the access from twenty feet to less that fourteen and a half feet. This has happened before in the HOA with the access on Beech Court for a trail. These owners (Woods) were told that they had to remove their rock wall and rebuild it inside the line which is marked by a nail in the curb.
When the complaint was filed with the Board for the property located at 13987 Cedar Court the Board looked into the issue, took some pictures, and came to a determination
They decided they would not follow past practice and have the owner vacate the HOA property. They decided that no action at all was necessary. They could have leased it to them so that the members of the HOA could retain ownership instead of allowing the homeowner to acquire it as their own. I guess per the Articles of Incorporation that the Board can give away our HOA property and make us all liable for diminishing the required access for emergency vehicles:
(d) acquire (by gift, purchase or otherwise), own, hold, improve, build upon, operate, maintain, convey, sell, lease, transfer, dedicate for public use or otherwise dispose of real or personal property in connection with the affairs of the Association;
Whose best interest are they serving here, the HOA members or one individual Homeowner? The Board does not have a problem enforcing rules on me. They do not even mind stretching the rules to say that they may apply to me, but than again I guess that I am not considered their friend. I guess that not all members are equal, it is one of those “who you know” deals. Hey Mr. HOA Man, What can I give you for a bigger slice of pie?
