ARTICLE III
PURPOSES

The purposes for which the Association is formed are:

l.          To provide for maintenance, preservation and architectural control of the residential lots, and the development and maintenance of the common areas, within that certain tract of property, (the "Property") described on Exhibit A, attached hereto and incorporated by this reference, and to promote the health, safety, and welfare of the residents within the above-described property and any additions thereto as may hereafter be brought within the jurisdiction of this Association.  Without limitation, the Association may:

This tree went down in the park on 12/22/08 during the storm.

Update on the tree in the park 02/01/2009 It looks like the home owners got tired of waiting for the HOA Board to resolve the issue and cut up the tree themselves. It makes you wonder why we have to pay such high dues when the homeowners have cut up the trees the last two years and maintained around the detention ponds.

Section 4.14. Maintenance Responsibility: Common Areas and Other. Maintenance, repair, replacement, improvements, taxes, insurance and other obligations and expenses or assessments arising from or through this Declaration or the recorded Plat shall also be the responsibility of the Association unless otherwise specified in this Declaration. In addition to the maintenance of the Common Areas, the Association shall maintain (if installed in the Plat): (1) the landscaping and signage installed by the Declarant or Association, (2) the entry monuments, (3) private lighting system, (4) signage or improvements, and (5) any storm water detention facilities outside of the public right-of-way (5) any playground equipment and pedestrian trails and pedestrian trail equipment (including but not limited to any and all detention ponds and associated conveyance systems whether within a tract, Common Areas or Lot). The Association shall perform regular maintenance upon the drainage facilities installed, or to be installed, upon the Plat. Regular maintenance shall include, at a minimum, annual inspection of the stormwater drainage system. As applicable, the system shall include the stormwater conveyance system pipes, ditches, swales, and catch basins; stormwater flow regulation system detention ponds, vaults, pipes, retention ponds, flow regulation and control structures; infiltration systems and water quality control system. The City of Sultan shall have the perpetual right of entry across adjacent lands of the Owners for purposes of inspecting, auditing, or conducting required maintenance of the drainage facility. Maintenance and repair obligations with respect to any NGPA/E buffers lying adjacent to any Lot shall be the responsibility of the Association.

The Fitness Trail equipment is covered in slimy algae, moss and lichen. Make sure you wear your "work clothes" if you plan on using it provided you can even hang on.

This is a culvert that was plugged causing water to back up and the ground to get soft causing trees to fall in the NGP. These along with the detention ponds are to be maintained by the HOA and inspected annually at a minimum. I have not seen any inspection or maintenence records since the developement was managed by the Board.

This healthy Cottonwood was removed in tract #994, not because it was a hazard, but because a direcetor did not like it next to their home. I could imagine the expense of the climbers plus the boom truck. Ssee stump grinding Below. Ethics????

This stump in th play area at the park was not deemed hazardous by the board when the tree was removedl. Yet this one next to a Board Members house was a threat. It was contracted without HOA approval. The whole Board was not even in on the decision. One of theBoard members quit over this issue. I bet the removal came at a huge expense to the HOA.
